___ At Ranch ___ Via Transported Semen Steve Heckaman, agent for the above named stallion, will herein be
referred to as Breeder. This Service is engaged subject to the following:
- A Booking Fee of $500 of
the above fee is payable with this contract and the balance of $500 (*plus shipped semen
cost, if applicable) plus
all unpaid expenses will be payable upon receipt of an invoice or when the mare
leaves the farm, whichever is first. The Breeder requires 48 hours advance
notice when the Mare Owner wishes to remove his mare(s) from the farm. This
will allow us sufficient time to prepare the required health papers and final
statement so the Owner may settle his account. The booking fee is
non-refundable. 18% interest per annum will be charged on all accounts in
excess of thirty days. This contract is governed by the laws of the state of
Texas.
- A photostatic copy of
registration papers (both sides), a veterinarian's health certificate, worming,
and immunization records shall accompany mare. If these are not presented upon
mare's arrival, the Breeder shall have the attending veterinarian make proper
tests and evaluations at the Mare Owner's expense. Mare (and foal, if
applicable) will be periodically vaccinated and wormed as deemed necessary by
our veterinarian at Mare Owner's expense. Flu and pneumobort K vaccine must be
given before the mare arrives. A current Coggings Test shall be furnished upon
delivery of mare to the breeding farm. It is recommended that mares be wormed
within 60 days of entering the farm.
- The Mare Owner shall agree that
each mare offered for breeding shall be in sound breeding condition and free
from infection or disease. Any mare certified by the attending veterinarian not
to be, in his opinion, in sound breeding condition shall not be bred. A Mare
Owner may substitute another mare within that breeding season.
- The Breeder agrees to diligently
try and settle the above named mare and shall have sole discretion of
determining the best method of breeding such mare. If, however, the mare does
not settle, the Breeder shall not be held harmless. There will be no guarantee
of a live foal for any mare leaving Steve Heckaman Quarter Horses before being
checked safe in foal by the attending veterinarian.
- Live Foal Guarantee. Live foal
means the foal shall stand and nurse. It is understood that if the mare proves
barren, aborts her foal, or if the foal is stillborn, A RETURN SEASON WILL
BE GUARANTEED THE FOLLOWING YEAR ONLY , providing notification is given.
Proper notification shall be defined as follows: Written certification by a
licensed veterinarian within 7 days that the mare has slipped or produced a
Non-Viable foal. Mare Owner certifies that such abortion or death did not
result from any act or omission of the Owner subsequent to the mare's departure
from Steve Heckaman Quarter Horses. Booster Rhinopneumonitis be administered as
indication by the individual drug manufacturer as the mare progresses through
her pregnancy. Failure to do this will void live foal guarantee.
- Rebreeds are subject to an
additional chute fee plus any increases in breeding fee. No live foal guarantee
on third year rebreeds.
- Color Guarantee: Rebreed in
________________ only with __________________ chute fee.
- The breeding season in force for
this contract shall begin February 1st and close July 1st of the year covered
by this contract.
- It is further agreed that should
the above named stallion die, or become unfit for service, or, if the above
named mare dies, during the breeding season then the Mare Owner may substitute
another mare or breed the above named mare to another stallion on the farm that
is agreed to by both the Mare Owner and Breeder.
- A breeder's certificate will be
issued to Mare Owner after all expenses have been paid in full and upon
notification of the birth of the foal.
- Waiver of Liability. It is
understood the breeding farm, its owners, stallion owners, employees,
Veterinarians, and guests shall not be liable for any injury, escape,
disability, or death of any horse on its premises. The above named Mare Owner,
whose horse(s) are under the care of Steve Heckaman Quarter Horses will not be
liable or responsible for any damage, injury or death to the breeding farm
stallions, employees, veterinarians, or other animals in the care of Steve
Heckaman Quarter Horses, whether or not caused by his horse.
- When the above named Mare Owner
signs and returns one copy of this contract to the Breeder, it will then be a
binding contract on both parties, subject to the above terms and conditions.
This contract is not valid unless completed in full.

Semen

- The STALLION SERVICE
FEE and shipping fee must be paid in full prior to shipment. Payment in U.S.
funds, credit card, certified or cashiers check only. The stallion service
fee will be evidenced by signature on attached Breeding Contract. The shipping
fee shall be $200.00 per shipment via FED-EX, UPS or other means of
overnight ground transportation. The shipping fee includes semen
collection/packaging, ground delivery and a disposable shipping container. If a
Hamilton-Thorne Equitainer is used, there will be a $250 deposit (credit card
guaranteed). A late fee may be charged for failure to return Equitainer
promptly. If shipment by counter to counter air transport is required, there
will be an additional $100.00 charge. Hamilton-Thorne Equitainers will
be used on all counter to counter shipments. Containers must be returned at the
mare owners expense.
- Mare owner's shall
receive up to three (3) shipments of cooled semen for the listed stallion
service fee. Breeder's date of delivery by a licensed veterinarian. Semen may
be used for the designated mare only.
- Stallion has been DNA
typed. The semen has been analyzed and tested and is free from infectious
disease. Sperm count, motility, collection and packaging procedures meet and/or
exceed industry standards.
- Request for semen must be
received by 8:00 PM the night prior to shipping, and for a regularly scheduled
breeding day. Weekend deliveries are subject to scheduling availability. All
requests for semen shipments shall be filled as received, subject to
availability. If there is insufficient semen to fill all orders on a given day,
the farm veterinarian will determine which orders are to be honored. This
decision will be based on information provided by the purchaser's
veterinarian.
- If the mare fails to
conceive by the 3rd shipment in one year, the mare may be serviced at Steve
Heckaman Quarter Horses prior to June 30th of the contract year or the
following breeding season. Should shipments the following year become
necessary, a chute fee of $300.00 will be charged.
- Responsibility for
insurance and risk of loss passes to the mare owner with this contract.
Owner assumes the unavoidable risks inherent in all horse-related activities:
including, but not limited to the semen, shipping container, owner's horse (s),
owner, and family members. Owner agrees to look solely to his insurance for
compensation for any such loss, and further agrees to indemnify and hold
harmless the stallion breeder, agents, veterinarians, employees, and
family.
- Mare owner further agrees
that contract is made and entered into the County of Denton, the State of
Texas, and that it shall be interpreted, enforced and transacted under the laws
of said state, and within the designated county, regardless of the manner of
breeding solicitation
- Mare owner's signature
on this contract that he/she has read and fully understands all of the terms
and conditions outlined herein, and accepts this contract as a legal and
binding instrument on behalf of the owner, owner's heirs, successors and
assigns. This agreement, along with the accompanying stallion service contract,
constitutes the entire agreement between the parties. No other agreements,
whether verbal or implied, are included. This contract may not be transferred
or assigned.
